Pavo in Ireland and the European Economic Area

Last updated: October 25, 2026

What this page is. A plain-English summary of the terms that apply to a business established in Ireland, or in another EEA member state where Pavo has opened, that uses Pavo. It is not itself a contract. The binding text is in the three documents linked below: Terms of Service, Section 28 (Ireland and the European Economic Area), Privacy Policy, Section 8 (EU/EEA — GDPR) and Data Processing Agreement, Section 8 (International Data Transfers). Where this page and those documents differ, the documents govern.
Status. Pavo is not yet open to new businesses in Ireland or elsewhere in the EEA. These terms are published ahead of the opening so that sellers can read them before they sign up. Before the first EEA seller signs up, Pavo will name its representative in the European Union under Article 27 of the GDPR in the Privacy Policy. When you create an account you will be asked to agree to the Terms of Service and the Privacy Policy, including the EEA sections, before you can use the Service.

1. Who you are dealing with

Pavo is software made by Emmber, Inc., a Delaware corporation in the United States. Emmber has no office, branch or company in Ireland or elsewhere in the EU. Your contract for the software is with Emmber, Inc. (Terms, Section 28.16).

The card payments you take are processed and settled by Stripe Technology Europe Limited, authorised by the Central Bank of Ireland as an electronic money institution (reference number C187865) and passported across the EEA. You open your own Stripe account when you set up payments, under Stripe’s own agreement with you. Pavo is not authorised by the Central Bank or any other EEA regulator, does not provide payment services, and never holds your money: it sits in your Stripe account until Stripe pays it out to your bank (Terms, Section 28.2).

2. What Pavo costs

Everything is in euro (or your country’s currency where Stripe settles in it). Pavo gives at least 30 days’ written notice before changing your country’s price (Terms, Section 28.3).

3. Card surcharges

EU law (the second Payment Services Directive, in Ireland Regulation 86(6) of the 2018 Payment Services Regulations) bans surcharges on consumer debit and credit cards. Pavo never adds a card fee or surcharge to a customer’s payment, and the customer card fee that Pavo may later offer US sellers will never apply to an EEA seller. You must not add one either (Terms, Section 28.4).

4. Payouts

Stripe pays your balance out to your bank account. A new seller’s first payouts are delayed while Pavo and Stripe review early activity. If refunds or disputes leave your Stripe balance negative, Stripe can debit your bank account for the difference (Terms, Sections 28.7 and 5.9).

5. VAT and tax forms

Pavo does not charge VAT on its fee. Emmber is outside the EU and you are a business, so you account for the VAT yourself under the reverse charge (Articles 44 and 196 of the VAT Directive). Send your VAT number to [email protected]; if you are not VAT-registered, your member state may require you to register to account for services received from abroad (Ireland has no threshold for received services). You handle VAT on your own sales (Terms, Section 28.5).

Pavo does not file the US Form 1099-K for EEA sellers. Because Emmber is a US company, it may ask you to confirm that your business is not a US person on IRS Form W-8BEN (sole trader) or W-8BEN-E (company) (Terms, Section 28.6).

6. Law, courts and complaints

For EEA sellers the Terms are governed by the law of Ireland, and the courts of Ireland decide disputes, without removing your right under EU law to be sued at home. The US arbitration clause, class action waiver and jury waiver do not apply to you. The EU’s online dispute resolution platform has been closed and no longer applies (Terms, Section 28.9).

Complaints about Pavo go to [email protected]; Pavo acknowledges them within five business days and aims to answer within 15. Complaints about Stripe’s payment services go to Stripe and, for a business with turnover of €3 million or less, may then go to the Financial Services and Pensions Ombudsman (Terms, Section 28.14).

7. Your data and your customers’ data

The GDPR applies. Emmber, Inc. is the controller of the data about you and your account, and your processor for the data about your customers. Your data is stored in the United States under the European Commission’s standard contractual clauses, not under the EU-US Data Privacy Framework. You can delete your account from Settings, get a copy of your data by email, and complain to the Data Protection Commission (Privacy Policy, Section 8; DPA, Section 8).

Pavo sends marketing email only with your consent or where the ePrivacy rules of your member state allow it, with an unsubscribe link in every message. Receipts, payout and security notices are service messages, not marketing. Pavo’s assistant in the app is an AI system and says so (Terms, Sections 28.11 and 28.12).
