Pavo in New Zealand

Last updated: October 25, 2026

What this page is. A plain-English summary of the terms that apply to a business in New Zealand that uses Pavo. It is not itself a contract. The binding text is in the three documents linked below: Terms of Service, Section 26 (New Zealand), Privacy Policy, Section 23 (New Zealand — Privacy Act 2020) and Data Processing Agreement, Section 8 (International Data Transfers). Where this page and those documents differ, the documents govern.
Status. Pavo is not yet open to new New Zealand businesses. These terms are published ahead of the opening so that sellers can read them before they sign up. When you create a New Zealand account you will be asked to agree to the Terms of Service and the Privacy Policy, including the New Zealand sections, before you can use the Service.

1. Who you are dealing with

Pavo is software made by Emmber, Inc., a Delaware corporation in the United States. Emmber has no office or company in New Zealand. Your contract for the software is with Emmber, Inc., in trade and for business use only; the Consumer Guarantees Act and the misleading-conduct sections of the Fair Trading Act are contracted out as those Acts allow for business contracts (Terms, Sections 26.1 and 26.16).

The card payments you take are processed and settled by Stripe New Zealand Limited, a company registered in New Zealand that refers unresolved complaints to Financial Services Complaints Limited, an approved dispute resolution scheme. You open your own Stripe account when you set up payments, under Stripe’s own agreement with you. Pavo is not on the Financial Service Providers Register, does not accept or transfer funds, and never holds your money: it sits in your Stripe account until Stripe pays it out to your bank (Terms, Section 26.2).

2. What Pavo costs in New Zealand

Everything is in New Zealand dollars. Pavo gives at least 30 days’ written notice before changing the price, and you can close your account before a change takes effect (Terms, Section 26.3).

3. Card surcharges

Pavo never adds a card fee or payment surcharge to a customer’s payment, and the customer card fee that Pavo may later offer US sellers will never apply to a New Zealand seller. You must not add one through the Service either. That keeps you clear of the Commerce Commission’s surcharging rules and of any surcharge ban Parliament passes (Terms, Section 26.4).

4. Payouts

Stripe pays your balance out to your New Zealand bank account. A new seller’s first payouts are delayed while Pavo and Stripe review early activity. If refunds or disputes leave your Stripe balance negative, Stripe can debit your bank account for the difference (Terms, Sections 26.7 and 5.9).

5. GST and tax forms

If you are GST-registered and use Pavo for your business, Pavo charges no GST on its fee: the law treats a remote service to a registered business as supplied outside New Zealand. Give Pavo your GST number or NZBN at sign-up. If you are not GST-registered, Pavo may have to add GST later and will give you 30 days’ notice first. You handle GST on your own sales (Terms, Section 26.5).

Pavo does not file the US Form 1099-K for New Zealand sellers and does not report your income to Inland Revenue. Because Emmber is a US company, it may ask you to confirm that your business is not a US person on IRS Form W-8BEN (sole trader) or W-8BEN-E (company) (Terms, Section 26.6).

6. Law, courts and complaints

For New Zealand sellers the Terms are governed by New Zealand law, and the New Zealand courts decide disputes. The US arbitration clause, class action waiver and jury waiver do not apply to you. Either side can end the relationship; Pavo gives 30 days’ notice when it ends it for convenience (Terms, Sections 26.9 and 26.10).

Complaints about Pavo go to [email protected]; Pavo acknowledges them within five business days and aims to answer within 15. Complaints about Stripe’s payment services go to Stripe and may then go to Financial Services Complaints Limited (Terms, Section 26.15).

7. Your data and your customers’ data

The Privacy Act 2020 applies to Pavo. Emmber, Inc. holds the information about you and your account, and holds your customers’ details as your agent. Your information is stored in the United States under a written agreement that gives it comparable protection, as information privacy principle 12 allows. The pay page and receipt tell your customers that their details were collected, as principle 3A requires from May 2026. You can ask to see and correct your information, delete your account from Settings, and complain to the Privacy Commissioner (Privacy Policy, Section 23; DPA, Section 8).

Pavo sends marketing messages only with your consent under the Unsolicited Electronic Messages Act, with an unsubscribe facility in every message honoured within five working days. Receipts, payout and security notices are service messages, not marketing (Terms, Section 26.12).
